Welcome to StreetRides US. StreetRides US operates this store and is the seller for purchases made through it. Joy Technologies LLC is the parent company and legal entity behind StreetRides US. The terms "we", "us", and "our" refer to StreetRides US and, where legally applicable, Joy Technologies LLC. Together, we provide this website and its related information, content, features, tools, products, and services (the "Services"). StreetRides US is powered by Shopify, which enables us to provide the Services to you.

The terms below, together with any policies referenced here (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers, limitation of liability, mandatory arbitration, and a class action waiver.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence. You have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including browsing our online store or purchasing any products, you may be asked to provide certain information such as your email, billing address, payment, and shipping information. You represent that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — OUR PRODUCTS

We have made every effort to provide an accurate representation of our products. Colors and product appearance may differ from how they appear on your screen due to your device type and settings.

We do not warrant that the appearance or quality of any product will meet your expectations. All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product, limit quantities, or restrict shipping to any person, region, or jurisdiction.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase. StreetRides US reserves the right to accept or decline your order for any reason at our discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you using the contact information provided at order time.

Your purchases are subject to return or exchange only in accordance with our Refund Policy.

You represent that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will appear in your order confirmation email. Posted prices do not include sales tax or shipping unless expressly stated.

You agree to provide current, complete, and accurate purchase, payment, and account information.

You represent that the payment information you provide is true and correct, you are authorized to use the payment method for the purchase, and you will pay all charges at the posted prices including shipping and applicable taxes.

SECTION 5 — SHIPPING AND DELIVERY

We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.

Products are fulfilled from the applicable manufacturer or distributor warehouse in the United States. StreetRides US remains your point of contact for order and delivery support.

SECTION 5A — ASSUMPTION OF RISK (E-MOBILITY PRODUCTS)

You acknowledge and agree that electric bikes, electric scooters, hoverboards, electric skateboards, all-terrain vehicles, and similar e-mobility products sold by StreetRides US involve inherent risks, including but not limited to falls, collisions, mechanical failure, electrical malfunction, fire, injury, and death.

By purchasing or using these products, you voluntarily and knowingly assume all risks associated with their use, whether known or unknown. You agree that StreetRides US, Joy Technologies LLC, our suppliers, and Shopify are not liable for any injury, property damage, or loss arising from your use or misuse of any product purchased through the Services.

SECTION 5B — SAFETY, HELMETS, AND LOCAL COMPLIANCE

You are solely responsible for:

1. Wearing appropriate safety gear including a helmet that meets U.S. CPSC, ASTM, or DOT standards
2. Following all federal, state, and local laws governing the use of e-mobility products, including but not limited to state/local e-bike classification rules (Class 1, 2, or 3 where applicable), speed limits, age restrictions, helmet requirements, lighting requirements, and registration where required
3. Riding only in locations where the product is legally permitted
4. Operating the product within the manufacturer's stated specifications, including maximum rider weight and intended terrain
5. Maintaining the product in safe operating condition

Failure to comply with applicable laws, the delivered manual, or required safety practices may affect warranty eligibility under the manufacturer's terms. Nothing in these Terms limits rights that cannot lawfully be waived.

SECTION 5C — BATTERY AND CHARGING SAFETY

Lithium-ion batteries pose a fire risk if mishandled. You agree to:

1. Use only the charger supplied with your product
2. Never charge a battery unattended or near flammable materials
3. Never charge, store, or operate a damaged, swollen, or wet battery
4. Discontinue use immediately if the battery emits heat, smoke, or unusual odor
5. Follow all manufacturer instructions for charging, storage, and disposal

StreetRides US is not liable for fire, property damage, or injury arising from improper charging, storage, modification, or use of any battery.

SECTION 5D — AGE RESTRICTIONS AND MINORS

Certain products, including but not limited to ATVs, off-road vehicles, and Class 3 electric bikes, are subject to age restrictions that vary by state. You are responsible for verifying the legal minimum age in your state of residence before purchase and use.

If you are purchasing on behalf of a minor, you accept full responsibility for the minor's safe and lawful use of the product. StreetRides US is not liable for any injury or damage arising from use by a minor.

SECTION 6 — INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement of these elements, are owned by Joy Technologies LLC, its affiliates, or licensors, and are protected by U.S. and foreign intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent.

StreetRides US names, logos, product and service names, designs, and slogans are trademarks of Joy Technologies LLC. You must not use such trademarks without our prior written permission. Shopify's name, logo, and trademarks remain property of Shopify. All other names and logos are property of their respective owners.

SECTION 7 — OPTIONAL TOOLS

You may be provided access to third-party customer tools as part of the Services. We provide these tools "as is" and "as available" without warranties of any kind. Your use of any optional third-party tool is at your own risk. You should review and approve the terms of the relevant third-party provider before use.

SECTION 8 — THIRD-PARTY LINKS

The Services may contain links to third-party websites or embedded third-party functionality. We are not responsible for the content or accuracy of third-party materials. We are not liable for any harm related to your access to third-party websites or your purchase of any third-party products.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

StreetRides US is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with StreetRides US. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sales between you and StreetRides US, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with StreetRides US.

SECTION 10 — PRIVACY POLICY

All personal information we collect is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes information about your use of the Services. By using the Services, you acknowledge that you have read these privacy policies.

SECTION 11 — FEEDBACK

If you submit any ideas, suggestions, feedback, reviews, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.

You represent that you own or have all necessary rights to the Feedback you submit. You agree your Feedback will not violate any third-party rights and will not contain unlawful, defamatory, abusive, or obscene content.

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change or cancel orders if any information is inaccurate, including after submission.

SECTION 13 — PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services to violate any law, infringe intellectual property rights, harass or harm others, transmit false information, send spam, impersonate others, transmit malicious code, scrape data, deploy AI tools or agents in violation of Section 14, or interfere with site security.

We reserve the right to suspend, disable, or terminate your account at any time without notice if we determine you have violated these Terms.

SECTION 14 — AGENTS

14.1 This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of any person or entity.

14.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates in strict accordance with Section 14.4.

14.3 We may limit, by technical or other means, how any Agent accesses the Services.

14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests with the user agent string "Agent/[agent name]"; (ii) not conceal that interactions are from an Agent or mimic human behavior; (iii) not bypass CAPTCHAs; (iv) respond truthfully when asked if the interaction is from a human; (v) not circumvent any measures we use to control Agent access.

SECTION 15 — TERMINATION

We may terminate this agreement or your access to the Services at any time without notice. You remain liable for all amounts due up to the date of termination.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Assignment, Governing Law, Arbitration, and Privacy Policy.

SECTION 16 — DISCLAIMER OF WARRANTIES

The information presented on or through the Services is for general information purposes only. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is at your own risk.

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL STREETRIDES US, JOY TECHNOLOGIES LLC, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.

SECTION 18 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Joy Technologies LLC, StreetRides US, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising from (1) your breach of these Terms, (2) your violation of any law or third-party right, (3) your use of any product purchased through the Services, or (4) your access to and use of the Services.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law. The unenforceable portion shall be severed, and the remaining provisions shall continue in full force.

SECTION 20 — WAIVER; ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision. These Terms and any policies posted by us constitute the entire agreement between you and us, superseding any prior agreements.

SECTION 21 — ASSIGNMENT

You may not assign or transfer this agreement or any of your rights or obligations without our prior written consent. We may assign or transfer these Terms without consent or notice to you.

SECTION 22 — GOVERNING LAW

These Terms and any agreements under which we provide you Services shall be governed by the laws of the State of Wyoming, without regard to its conflict of laws principles.

SECTION 22A — MANDATORY ARBITRATION; CLASS ACTION WAIVER

Please read this section carefully. It affects your legal rights.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product purchased through the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Sheridan, Wyoming, or by remote hearing at the arbitrator's discretion. The arbitrator's decision is final and binding.

Class action waiver. You agree that any arbitration or proceeding shall be conducted on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative action.

30-day exception. Notwithstanding the above, you may bring an individual claim in small-claims court in Wyoming if the claim qualifies.

Opt-out. You may opt out of this arbitration agreement by emailing info@streetrides.ca within 30 days of your first purchase, with the subject line "Arbitration Opt-Out" and including your full name, address, and order number.

SECTION 23 — HEADINGS

The headings used in this agreement are for convenience only and do not limit or affect these Terms.

SECTION 24 — CHANGES TO TERMS OF SERVICE

You may review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of the Services following any changes constitutes acceptance of those changes.
